These Terms of Service ("Terms") govern your access to and use of ViewPnt's mobile application and website (viewpnt.app). By creating an account or using ViewPnt, you agree to be bound by these Terms. If you do not agree, do not use the app.

You must be at least 17 years old to use ViewPnt. By using the app, you represent and warrant that you meet this age requirement. If you are under 18, you must have your parent or legal guardian's permission to use ViewPnt and they must agree to these Terms on your behalf.
To use ViewPnt, you must create an account using email and password, Sign in with Apple, or Sign in with Google. You are responsible for:
We reserve the right to suspend or terminate accounts that violate these Terms or our Community Guidelines.
You retain ownership of the content you create and post on ViewPnt, including debate videos, audio, and text. By posting content on ViewPnt, you grant us a non-exclusive, royalty-free, worldwide, sublicensable license to use, display, reproduce, distribute, modify, and create derivative works of your content solely for the purpose of operating, improving, and promoting ViewPnt.
You are solely responsible for the content you post. You represent and warrant that:
All debates, your win/loss record, and your public profile are visible to all ViewPnt users by default. When you use the challenge feature to share content to X or other social platforms, that content becomes subject to those platforms' terms and conditions.
You may not post, upload, or include in a debate any content that you do not own or do not have the legal right to use. This includes, without limitation, clips or footage from movies, television shows, or streaming content; music or audio recordings; sports broadcasts; news footage; and any other copyrighted material belonging to a third party, unless you have obtained the necessary rights or permissions, or your use qualifies for an exemption such as fair use under applicable law. ViewPnt does not determine whether a particular use qualifies as fair use, and posting such content is at your own risk.
ViewPnt respects the intellectual property rights of others and expects users to do the same. If you believe content on ViewPnt infringes your copyright, you may send a notice to our designated agent at support@viewpnt.app. To be effective, your notice should include, to the extent possible:
Upon receipt of a valid notice, we will remove or disable access to the identified content and notify the user who posted it. Users who receive repeated valid infringement notices may have their accounts suspended or terminated.
If you believe content you posted was removed in error or misidentification, you may submit a counter-notice to support@viewpnt.app containing your identification and signature, identification of the removed content and its prior location, and a statement under penalty of perjury that you have a good faith belief the content was removed by mistake, along with your consent to the jurisdiction of the federal court in your district (or Arizona, if you are outside the U.S.).
ViewPnt does not pre-screen content posted by users and is not responsible for verifying that users have the rights to the third-party content they post. To the maximum extent permitted by law, ViewPnt is not liable for any infringing content posted by users, and responsibility for such content rests solely with the user who posted it.
This section is important. Please read it before posting debates on ViewPnt.
ViewPnt is a debate platform where your content directly affects other users' records. When you participate in a debate, the result becomes part of your opponent's permanent win/loss record. Because of this, the following applies when you delete your account:
By creating an account and participating in debates on ViewPnt, you acknowledge and agree to these retention terms. If you do not agree to your username and debate content being retained after account deletion, do not participate in debates.
ViewPnt has zero tolerance for objectionable content and abusive users. Content or behavior that violates this policy will be removed and enforced against as described below.
You agree not to:
ViewPnt reserves the right, but has no obligation, to review, monitor, and remove any content at our sole discretion, with or without prior notice. This includes, without limitation, content that contains racial slurs, hate speech, or other discriminatory or dehumanizing language directed at a person or group based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin. Debating a controversial topic does not permit the use of slurs or language intended to demean or dehumanize others.
We may remove content, restrict features, suspend, or permanently terminate accounts that violate these Terms or our Community Guidelines. We are under no obligation to provide advance notice before taking action, and we are not liable to you for the removal of content or the suspension or termination of your account under this section.
Reporting and enforcement. Users can flag objectionable content or block abusive users directly within the app. When content is reported or a user is blocked, we remove the reported content from the reporting user's feed immediately. Our team reviews all reports of objectionable content and abusive behavior and, where a violation is confirmed, removes the content and ejects the offending user within 24 hours of the report.
ViewPnt is a platform for good-faith debate. You agree to engage in debates honestly and authentically. Manipulation of votes, creating fake accounts to influence outcomes, coordinating inauthentic activity, or any other means of artificially affecting debate results is strictly prohibited and will result in account suspension or permanent ban.
ViewPnt and its original content, features, and functionality are owned by ViewPnt and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services or software without our prior written consent.
If you believe any content on ViewPnt infringes your copyright, please contact us at support@viewpnt.app.
You may delete your account at any time through the app under Settings → Account → Delete Account, or by visiting viewpnt.app/delete-account.
Upon account deletion:
We may also suspend or terminate your account at our discretion for violations of these Terms or our Community Guidelines, with or without notice.
ViewPnt is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, secure, or error-free.
Opinions expressed in debates are those of individual users and do not represent the views of ViewPnt.
To the maximum extent permitted by law, ViewPnt and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of ViewPnt. Our total liability to you for any claims shall not exceed the amount you paid us in the twelve months preceding the claim (or $100 if you have not paid us anything).
You agree to indemnify and hold harmless ViewPnt and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of ViewPnt, your content, or your violation of these Terms.
These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Arizona.
We may update these Terms at any time. We will notify you of material changes through the app or by email at least 14 days before they take effect. Continued use of ViewPnt after changes become effective constitutes your acceptance.
